CIVIL & COMMERCIAL LITIGATION

Civil & commercial litigation lawyer in Moldova

The Law Office of Attorney Bîrcă Ludmila represents private individuals and businesses in civil and commercial litigation across Chișinău and the Republic of Moldova — from contract disputes and debt recovery to shareholder conflicts, liability claims and enforcement. With 20 years in law and 15 years in practice, we handle each case with rigor, transparency and full protection of attorney-client confidentiality, whether you live in Moldova, abroad in the diaspora, or hold interests in the country as a foreign national.

What civil and commercial litigation covers

Civil litigation concerns disputes between individuals and legal entities: contracts, property, compensation, inheritance and liability for damage. Commercial litigation arises between businesses and professionals over contract performance, unpaid invoices, relationships among partners, and the responsibility of company directors.

Many conflicts can be resolved without a courtroom, through negotiation or a formal pre-litigation notice. When court proceedings are unavoidable, a clear strategy and well-prepared evidence make the difference in how the case is managed.

We help you assess the situation objectively — the merits, the risks and the realistic timelines — so you can make an informed decision before committing.

What the litigation service includes

Our assistance spans the full life of a case, from preliminary analysis through to enforcement of the judgment. Each stage is explained in advance, under a written engagement with transparent terms.

  • Initial consultation and an honest assessment of the case
  • Negotiation, formal notices and amicable settlement
  • Drafting claims, defences and appeals
  • Representation before first-instance, appeal and cassation courts
  • Debt recovery and protective measures such as seizure
  • Support during enforcement of court judgments

Remote service for the diaspora and foreign clients

If you live abroad — in Italy, Germany, France, the United Kingdom, the United States or elsewhere — you do not need to travel to pursue or defend a claim in Moldova. We conduct consultations by WhatsApp, Viber or Zoom and can act under a power of attorney.

A power of attorney executed abroad usually needs to be legalized for use in Moldova — often via apostille and a certified Romanian translation. We advise on the exact form required for your country and guide you through each step.

Working in Romanian, Russian and English, we keep correspondence clear and documented, so distance is never an obstacle to representation.

Orientative costs and transparency

Fees are set individually, based on the complexity of the matter, the volume of work and the procedural stages involved. They may be agreed as a fixed fee per stage or on an hourly basis, in line with Law no. 1260/2002 on the legal profession.

Any figure given as an example is orientative and may change. State court fees and other litigation costs may apply; we estimate these together with you before starting.

You will receive clear written terms before any financial commitment, with no hidden charges.

Why this office

Attorney Bîrcă Ludmila graduated from the Faculty of Law of the State University of Moldova (USM) and holds a Master of Laws. Before entering private practice in 2011, she served from 2006 to 2011 as a state specialist in consumer protection — experience that brings a practical perspective to contractual relationships and commercial disputes.

We work in Romanian, Russian and English and offer remote consultations as well as document handling by power of attorney, so clients in Moldova and across the diaspora can be represented efficiently.

Communication is direct, and the information you share is protected by attorney-client confidentiality.

Frequently Asked Questions

  • Often yes. Many disputes are settled through negotiation, a formal notice or mediation. We assess that route first and litigate only when it is genuinely necessary.
