1. Who is responsible for this website
The avocata.md website belongs to the Law Office of Attorney Ludmila Bîrcă, a form of practising the profession of advocate registered in the Republic of Moldova. The complete identification details are displayed in the box above. Art. 12(1) of Law no. 284/2004 on electronic commerce requires a provider of information society services to ensure “easy, direct and permanent access to authentic information about itself in electronic form, in Romanian”, which is why the Romanian version of this page is the reference version.
The website is hosted on the infrastructure of Hetzner Online GmbH (Germany). It is not an online shop, it does not sell goods or services by electronic means and it does not process payments.
2. The regulatory framework of the profession
The profession of advocate is organised and supervised under Law no. 1260/2002 on the profession of advocate and the Code of Ethics of the advocate, adopted by the Union of Advocates of the Republic of Moldova. The competent professional body is the Union of Advocates of the Republic of Moldova.
Law no. 1260/2002 prohibits an attorney from advertising their professional activity, while allowing the online environment to contain information about the attorney. Consequently, this website is informative in character: it presents verifiable information about the attorney's training, licence and areas of practice. It does not and will not contain promises of results, comparisons with other attorneys, superlatives or client reviews.
A result obtained in a previous case does not guarantee a similar result in your case. Any assessment of the prospects of a course of action can be made only after examining the actual documents.
3. General information, not legal advice
The materials published on this website — articles, descriptions of services, answers to frequently asked questions and other texts — are exclusively for general information. They describe the legal framework in a simplified manner and cannot cover the particularities of every situation.

4. How the engagement is formed
Sending a message through the contact form, by e-mail, by telephone or through messaging applications does not, in itself, give rise to a contractual relationship and does not oblige the office to take the case on.
Legal assistance begins only after a number of steps have been completed: checking for any conflict of interests, confirming that the situation falls within the areas in which the office provides assistance, and concluding a written legal services agreement setting out the subject matter, the conditions and the fee.
Until the agreement is signed, please describe the situation briefly and do not send documents or details that you do not wish to disclose. Professional secrecy covers preliminary correspondence as well, but a web form is not the right channel for a case file; we discuss documents after the conflict-of-interests check, through a channel agreed between us.
5. Intellectual property and external links
The texts, structure, graphic elements and other materials of this website are protected by copyright legislation and belong to the Law Office of Attorney Ludmila Bîrcă or are used under a right of use. Their reproduction, distribution or modification for commercial purposes, without prior written consent, is not permitted. Quoting short extracts, with an indication of the source and of the link, is accepted within customary limits.
The website may contain links to external resources (for example official portals or information pages). These links are provided for your convenience. The office does not control the content of third-party websites and accepts no responsibility for their accuracy, availability or policies.
6. Limitation of liability and availability of the website
We make every effort to ensure that the information published is correct and up to date at the time of writing. Nevertheless, because of legislative changes and the general character of the texts, we cannot guarantee that every piece of information is complete, current or applicable to your situation.
To the extent permitted by law, the office is not liable for decisions taken solely on the basis of the content of this website, without individualised advice. The attorney's professional liability for the services actually provided is determined under the terms of the legal services agreement and of Law no. 1260/2002.
The website is made available as it is. There may be interruptions for maintenance or for technical reasons beyond our control. 7. Moldovan law services and clients from abroad
All the services offered concern the law of the Republic of Moldova and proceedings conducted on its territory. The office does not advise on the law of other countries.
Assistance can also be provided remotely — to persons in the diaspora and to foreign nationals with interests in Moldova — through online consultations and by handling documents on the basis of a power of attorney. Communication can take place in Romanian, Russian and English.
The fact that the website is available in other countries does not mean that the services are offered or authorised in those countries.
8. Confidentiality, professional secrecy and personal data
Any information communicated in connection with a legal matter is protected by the attorney's professional secrecy, guaranteed by Law no. 1260/2002. The secrecy applies even where, ultimately, the engagement does not come about.
Personal data is processed in accordance with Law no. 195/2024 on personal data protection. 9. Applicable law, complaints and changes
These terms, the use of the website and any legal relationship connected with them are governed by the law of the Republic of Moldova. Any disputes are settled by the competent courts of the Republic of Moldova.
We reserve the right to update these terms. The applicable version is the one published on the website at the date of access, indicated at the top of the page.
